Conditions générales d'Utilisation
1. Definitions
The terms indicated below with an initial capital letter have the following meaning in these General Terms and Conditions:
- General Terms and Conditions: these general terms and conditions of I Have Tickets (Jac-Y-Do), hereinafter referred to as IHT;
- Event: the organized event, such as an event of a musical, cultural, sporting and/or recreational nature, for which Event Holder sells Tickets;
- Event Holder: the natural or legal person who creates, produces and/or organizes an Event on the site and is responsible for it, with whom IHT enters into an agreement regarding an Event, or to whom IHT makes an offer to that end;
- Customer: the natural or legal person who purchases Tickets for an Event from Event Holder;
- Agreement: the agreement between IHT and Event Holder for the acquisition of Tickets for Events;
- Ticket: the document serving as an admission ticket for an Event, including electronic Tickets;
- I Have Tickets / Jac-Y-Do / IHT: the partnership Jac-Y-Do VOF established in Meppel.
- Bank: the private limited company Mollie, which handles payments between the various banks, IHT, and the Event Organizer; Mollie BV established in Amsterdam.
2. Applicability of General Terms and Conditions
- These General Terms and Conditions apply to all offers from, orders placed with, legal relationships, and agreements in which IHT supplies products or services of any nature to the Event Organizer, even if these products or services are not (further) described in these General Terms and Conditions.
- IHT expressly rejects the applicability of any other terms and conditions of the Event Organizer.
- Parties may only agree to amendments to the General Terms and Conditions in writing. IHT is entitled to amend the General Terms and Conditions and to declare amended General Terms and Conditions applicable to Agreements. The amended General Terms and Conditions can be consulted on the IHT website.
- The General Terms and Conditions of the Event Organizer of the Event also apply to the Agreement. In the event of conflict, the General Terms and Conditions of IHT shall prevail. If not yet in the possession of the Event Organizer, IHT will send the General Terms and Conditions of IHT upon request.
3. Formation of Agreement
- Unless otherwise agreed in writing, all offers, including advertisements and price lists as stated on the IHT website, are binding.
- Before confirming an event on the site, the Event Organizer must verify that all details have been entered truthfully and that the correct details have been entered on the IHT site.
- Before confirming their reservation, the Customer must always carefully check whether the correct Tickets have been reserved. The Customer must always use a correct (email) address when making the reservation. If the Customer chooses to receive Tickets electronically, the risk of loss, theft, or misuse of the Ticket rests with the Customer from the moment the Tickets have reached him.
- If there is doubt regarding the accuracy of the data entered by the Customer during the order, the Event Organizer may contact the Customer using the data entered by the Customer. If the Event Organizer cannot reach the Customer and is therefore unable to verify the data, the Event Organizer may proceed to cancel the reservation and sell the Tickets to another Customer. If the Event Organizer has doubts regarding the accuracy or validity of the data entered by the Customer during the order or the payment method used by the Customer, it has the right to cancel the Customer's reservation and sell the Tickets to another Customer. The Event Organizer will endeavor to inform the Customer in such a case.
- Every Agreement is entered into subject to the suspensive condition of sufficient availability of the relevant products or services.
4. Prices and payment
- IHT sells Tickets on behalf of the Event Organizer, who determines the price and the number of available seats. Information regarding price and availability is provided without obligation and subject to change.
- The Customer pays the price stated in the Agreement for the products or services ordered via the website. Payment is made in the manner indicated on the IHT website. Further (payment/order) conditions may apply to the order.
- All IHT prices as stated on this website are in euros excluding VAT, unless expressly stated otherwise.
- Depending on the chosen method, IHT charges the following costs:
1) If the Event Organizer processes payments through IHT:
Between 1 and 500 tickets: €1.50/ticket. 501 to 1000 tickets: €1.00/ticket. Above that: €0.75/ticket.
These costs will be deducted from the ticket price determined by the event holder.
2) If the event holder processes payments via their own Mollie account:
0 - 500 reserved and/or sold tickets: € 350.00
500 - 1,000 reserved and/or sold tickets: € 500.00
1,000 - 5,000 reserved and/or sold tickets: € 800.00
more than 5,000 reserved and/or sold tickets: € 1,000.00
- Payments from the Customer to IHT are settled immediately upon purchase of the ticket.
- Payments from IHT to the Event Holder will be transferred after the event, at the beginning of the following month, to the account provided by the event holder bank account.
- Any payments from the Event Holder to IHT must be settled within one month after the event.
- If the Event Holder fails to pay the amounts due on time, the Event Holder shall owe statutory interest on the outstanding amount, without any reminder or notice of default being required. If the Event Holder remains negligent in settling the claim after a reminder or notice of default, IHT may hand over the claim to a debt collection agency, in which case the Event Holder shall be obliged to reimburse all judicial and extrajudicial costs in addition to the total amount then due, including costs calculated by external experts in addition to the costs determined in court.
5. Delivery times
- Tickets will be sent to the (email) address provided by the Customer during the order. The Event Organizer will continue to consider the (email) address provided by the Customer as correct until the Customer has notified the Event Organizer of a new (email) address.
- The delivery times specified by IHT shall never be considered a firm deadline, unless expressly agreed otherwise. In the event of late delivery, IHT must be notified of the default in writing.
- Exceeding any delivery deadline does not entitle the Event Holder to compensation, nor does it entitle the Event Holder to cancel the order or dissolve the Agreement, unless the exceeding of the delivery deadline is such that the Event Holder cannot reasonably be expected to maintain the Agreement.
6. Cancelled or Postponed Events
- It is the Customer's responsibility to check whether an Event has been cancelled or postponed and what the new time or location will be.
- The Event Holder will attempt to inform the Customer of the cancellation or postponement.
- IHT is not responsible for any costs incurred.
- Tickets for postponed Events generally remain valid for the replacement Event. For more information regarding this, the Customer may contact the Event Organizer.
- If an Event is moved to another location or date, or is cancelled, the Event Organizer may set conditions regarding the reimbursement of the ticket price.
7.Tickets
- The Tickets distributed by IHT remain the property of the Event Organizer and are delivered to the customer on the condition that it is not permitted, without prior written consent from the Event Organizer and/or IHT, to sell the ticket to third parties or to provide it to third parties directly or indirectly in any other commercial manner, or to offer or use the ticket in commercial communications – in any manner whatsoever. In the event of a violation of the aforementioned condition, IHT and/or the Event Organizer are entitled to invalidate this ticket and/or impose a fine on the Customer. Holders of invalid tickets will be denied entry to the Event, without entitlement to compensation.
- Upon receipt, the Customer must check the Tickets, as errors cannot always be corrected. After purchase, Tickets cannot be exchanged or refunded.
- If the Customer's Ticket is damaged to such an extent that its authenticity can no longer be verified, the Customer may contact the Event Organizer.
- Special requests, such as reserving wheelchair spaces, must be made known in a timely and explicit manner. IHT cannot guarantee that special requests can be accommodated. For more information regarding this, the Customer may contact the Event Organizer.
8. Intellectual and Industrial Property Rights
- The industrial and intellectual property rights vested in the IHT Ticket belong to IHT or its licensor. The Customer and Event Organizer shall refrain from conduct that could harm the rights or other interests of IHT or its licensor in this regard.
- The Customer and Event Organizer are not permitted to remove or alter any indication concerning copyrights, trademarks, trade names, or other intellectual or industrial property rights of the Ticket, or to make any changes to the form or any other characteristic of the Ticket.
- The Customer is prohibited from falsifying, duplicating, or reproducing the Ticket in any way.
- The Agreement does not constitute the transfer of any intellectual property right of IHT to the Customer or of IHT to the Event Organizer.
9. Liability
- Except for the other liability provisions in these General Terms and Conditions, the total liability of IHT for attributable failure to perform or for unlawful act is limited to compensation for direct damage up to a maximum of the amount due to the Event Organizer pursuant to the relevant Agreement in is or can be charged, unless the damage is the result of intent and/or gross negligence on the part of IHT or its subordinates.
- The liability of IHT for attributable failure in the performance of an Agreement arises in all cases only if the Event Organizer immediately and properly notifies IHT in writing of the default, setting a reasonable period for remedying the default, and IHT continues to fail in the performance of its obligations in an attributable manner even after that period. The notice of default must contain as complete and detailed a description of the shortcoming as possible, so that IHT is able to respond adequately.
- The Event Holder indemnifies IHT against all claims from third parties relating to the Event Holder's failure to comply, or insufficient compliance, with any obligation towards IHT, whether or not arising from the General Terms and Conditions.
- A condition for the existence of any right to compensation is always that the Event Holder reports the damage to IHT in writing as soon as possible after it occurs.
- IHT cannot under any circumstances be held liable for any form of damage to or loss of the Ticket whatsoever. In the event of loss or theft, the Customer cannot claim a replacement Ticket or a refund of any monies from IHT. IHT is also not liable for delay or the non-delivery or incorrect delivery of Tickets, if the delay or the non-delivery or incorrect delivery cannot be attributed to IHT.
- IHT accepts no liability whatsoever for Tickets obtained by the Customer from third parties. IHT cannot guarantee the authenticity of this either.
- IHT cannot be held liable in any way for any damage suffered by the holder of this admission ticket due to acts or omissions of third parties.
